Fooday Application Terms of Service

1. Acceptance of Terms​

By accessing and using the Fooday application (the "App"), you agree to these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, do not access or use our App.

2. Description of Service​

Fooday is a food-centric mobile application that enables users to purchase Fooca Non-Fungible Assets (NFA) via in-app purchases, create and share restaurant spots or dining reviews, and discover good restaurants. Users may earn FOOD token rewards for certain activities performed on the App.

3. Eligibility​

You must be at least 13 years old to use our App. By agreeing to these Terms, you represent and warrant that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the App; and (c) your registration and your use of the App is in compliance with any and all applicable laws and regulations.

4. In-App Purchases​

In-app purchases of Fooca NFA can be made through applicable billing methods indicated in the App. All purchases are final and non-refundable. You are responsible for all in-app purchases made through your account.

5. FOOD Tokens​

FOOD tokens are awarded based on certain user activities, such as submitting restaurant reviews or creating restaurant spots. The value, use, and method of obtaining FOOD tokens may change at our sole discretion without notice.

6. User Content​

By posting content to the App, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of your content to provide the services and to promote Fooday, in any formats and through any channels.

7. Prohibited Activities​

You may not engage in the following prohibited activities:

  • (a) Violating any local, state, national, or international law;
  • (b) Infringing upon the rights of others;
  • (c) Attempting to exploit or harm minors in any way;
  • (d) Transmitting any form of harmful, threatening, abusive or hateful content;
  • (e) Creating fake restaurant spots or posting false, misleading, or deceptive reviews.

Violation of these rules, as determined by Fooday in its sole discretion, may result in immediate termination of your account and legal action, if warranted.

8. Termination​

We reserve the right to terminate or suspend your account at any time and for any reason, including any violation of these Terms.

9. Additional Clause on Account Usage​

Restrictions on Creating Multiple Accounts:​

Monitoring for Duplicate Accounts: If we detect that two accounts are consistently operating from the same IP address over a long period, or if we find significant similarities in the reviews or GPS tracking data between accounts, we will consider these accounts as suspicious.

Our Discretion in Identifying Duplicate Accounts: The determination of whether accounts are created or operated by the same individual is at our sole discretion. We will conduct a thorough review based on the data and behavior associated with the accounts in question.

Consequences for Duplicate Accounts: Accounts identified as duplicates will be permanently frozen and removed from the Fooday app. All earnings, tokens, and data associated with these accounts will become inaccessible and non-recoverable.

Restrictions on Email Addresses from Frozen Accounts: Any email address associated with a frozen account will be prohibited from creating new accounts on the Fooday app. This measure is to ensure fairness and prevent abuse of our system.

10. Changes to Terms​

Fooday reserves the right to change these Terms at any time without notice. Your continued use of the App following any changes signifies your acceptance of our revised Terms.
